In the past decade, “Design and Build” (D & B) has become a prominent procurement route in the construction industry, both public and private sectors in Malaysia. This trend was primarily driven by employers wish for a building procurement system with single point responsibility, whereby the Contractor undertakes not only the construction but also the design aspects. Essentially to transfer the design and other associated risks to the party who is more capable of managing them; the D & B Contractor, who can tap on his construction experience to incorporate “buildability / constructability” or simply practicality in the design, thus improving speed and quality of the design and detailing so as to benefit the construction process, in terms of time and costs to the project. In transferring most of the project risks to the Contractor, the latter is then contractually responsible and liable for them under a D & B contract.
